The information below covers the terms and conditions for Duke Street Art Ltd. gallery and website. These terms and conditions apply to the use of Duke Street Art Ltd. gallery and website, and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out below.

 

If you have any questions relating to these terms and conditions please contact our gallery staff between the GMT hours of 10:30 and 18:00 (Mon - Sat) 12:00 and 17:00 (Sun) before you place an order for Irish art.

 

Terms and Conditions of Sale

 

  • All art orders received by Duke Street Art Ltd. from the website are subject to availability of art works at the time of receipt and acceptance of order. In in the unlikely case that the desired artwork can not be located when processing a customers weborder, the customer will receive a full refund for their purchase.

 

  • Acceptance of orders by Duke Street Art Ltd for art works are subject to clearance of funds and where applicable authorisation of debit and/or credit card details. For the avoidance of doubt art work remains the property of Duke Street Art Ltd until cleared funds are received and Duke Street Art Ltd reserves the right to sell art work to other parties until such funds are received.

 

  • Customers buying art work from Duke Street Art Ltd accept responsibility for any taxation or charges levied in respect of importation of art works they have ordered.

 

  • Art purchases will be processed in Euros and where applicable at the prevailing rate of exchange operated by our clearing merchant bank. In the event that Duke Street Art Ltd provides approximate conversion rate information in foreign currency this shall be for general guidance only.

 

  • In the event that any credit or debit card used by a customer to purchase art work has been used without relevant authority or otherwise improperly used the customer shall be obliged to return art works forthwith.

 

  • Customers warrant that they have authority to make art purchases from Duke Street Art Ltd in their own name and are 18 years of age or over.

 

  • Deposits placed at Duke Street Art Ltd are non refundable. Sales must conclude within one year of opening. After one year, deposits and layaway contracts become null and void. Goods remain property of Duke Street Art Ltd. until full and final payment is made. All goods can only be stored up to a maximum of 12 months, after which they will incur a storage fee.


  • While reasonable care is taken to ensure the accuracy of descriptions of goods offered for sale, such descriptions, whether in advertisements, brochures, catalogues, write-ups, literature, or any other form of audio or visual communication published or produced by or on behalf of the Duke Street Art Ltd are not, and shall not be taken to be, statements of fact or representations in relation to any such artwork. They are statements of the opinion of the Duke Street Art Ltd.

 

  • All artworks are available for inspection. A buyer who purchases an artwork from Duke Street Art Ltd. thereby acknowledges that he has satisfied himself as to the physical condition, state of repair or restoration, age and description of such artwork and also that he accepts these conditions of sale

 

  • Sometimes colours can have slight variations depending on how the camera picks up the colour range, and depending on the individuals computer resolution. This should be taken into account when purchasing online.

 

 

Payment Plans

 

A Payment Plan option is available on most artworks that are property of Duke Street Art Ltd. A customer can pay over a maximum of a 10 month period. Payments are taken off a customers credit card on the 1st of every month. A valid credit card is required for the period of time which the customer wishes to pay over. If the customer does not have a valid creditcard for the total term of the payment plan period, it is the customer's sole responsiblity to provide the Duke Street Art Ltd with their new creditcard details for subsequent payments. If the artwork is property of the Duke Street Art Ltd, and its full retail price is under 500.00euro, the customer may be allowed to take home the artwork once there payment plan is in place, and only if the customers creditcard is valid for the entire payment plan term. The customer will be asked to provide Duke Street Art Ltd. With a current driving licence or passport to confirm identity. In all other cases, the artwork must remain in the possession of Duke Street Art Ltd unless full and final payment is made. Customers credit card details provided as part of a payment plan will not be passed on to any third party. If taking on a payment plan option, the customer accepts these terms and conditions.

 

Shipping

 

Duke Street Art Ltd. ship worldwide. The upmost care is taking in the packaging of artworks for export however customers' requesting shipping do so at their own risk. Our shipping carriers are typically GLS and Fedex. Please note that, glass may have to be removed from a frame for the purposes of shipping an artwork to ensure the safety of the artwork in transit. Insurance can be arranged on shipments, which is billed to the customer separately. An additional charge from the shipping carrier may occur if an artwork is oversized which is invoiced to the customer. Customers will be solely responsible for any import tax that may occur within their own shipping country. Delivery time approximations once the artwork has been dispatched by our shipping carrier: Ireland: next day UK: 2 working days EUROPE: 3-4 days OTHER DESTINATIONS: 5-7 days. These times may vary. By requesting to have an artwork shipped the customer accepts these terms and conditions.

 

Gift Vouchers

 

Duke Street Art Ltd. Gift voucher can be exchanged for goods only at the Duke Street Art Ltd. Gift voucher may be exchanged for goods of the same price as its face value, or for goods of a higher price than the face value on payment of the difference. No change will be given. To deface the gift vouchers in any way will render it invalid. Lost or stolen gift vouchers cannot be exchanged or replaced. Duke Street Art Ltd is under no liability should gift vouchers be lost, stolen or damaged,. Gift Vouchers cannot be exchanged in Banks/Building Societies or Post Office. Gift Vouchers are non-refundable and cannot be exchanged in part or in full for cash. Gift Vouchers are valid for 12 months after the date of issue. For vouchers sold as part of an Offer, no discount will be available to the customer at the time of redeeming the gift voucher for goods at the Duke Street Art Ltd. Gift Vouchers sold as part of an offer are not redeemable against goods held on consignment. Consignment goods are not owned by the Duke Street Art Ltd and are sold on behalf of a third party. Gift Vouchers sold as part of an offer can not be used against items held in the Silent Auction at reserve prices. Gift Vouchers sold as part of an offer are not redeemable against goods already held on layaway. 

 

Goods held on Consignment

 

Pending Approval by the director of Duke Street Art Ltd. Artworks may be left in for sale via the Duke Street Art Ltd. All goods are left for sale at Duke Street Art Ltd are left in solely at owner's risk. Prior to goods being left in for sale at Duke Street Art Ltd., it is the owner's responsibility to have their property authenticated. The owner accepts the commission charge deducted from the sales price of goods by Duke Street Art Ltd. The owner agrees that the sale price is determined solely at the Duke Street Art Ltds discretion. Cheque payments due after a minimum of 30 days after final payment on the items have been made. All goods can only be stored up to a maximum of 12 months, after which they will incur a storage fee.

 

Returns of Artworks

 

Duke Street Art Ltd wants all customers to be completely happy with art work purchases made from Duke Street Art Ltd. Therefore at the discretation of the director, customers may exchange an artwork for another one of the same artist within a period of 28 days from date of purchase. This excludes a small number of artworks which has been left in for sale on behalf of a third party which are not property of the Duke Street Art Ltd. Alternatively customers may take a credit note valid for 12 months from date of issue. In the case where the original purchase was made with a Duke Street Art Ltd gift voucher, the original expiration date will be applied to the credit note. Customers wishing to return art work(s) do so at their own cost. Art work returned to Duke Street Art Ltd should be in original condition along with the packaging and with all relevant original documentation. Customers are advised to keep all receipts.

Copyright in all images and art works purchased or featured on Duke Street Art Ltd website vests in the artists and gallery as the case may be and in no case may any party reproduce such images without written consent.

Duke Street Art Ltd fully respects your right to privacy and will not collect any personal information about you on this website without your clear permission. Any personal information which you volunteer will be treated with the highest standards of security and confidentiality.

 

Duke Street Art Ltd does not collect any personal data about you on this website, apart from information which you volunteer. Any information which you provide in this way is not made available to any third parties. Duke Street Art Ltd assures that all individually identifiable information is kept confidential.

 

For general web browsing no personal information is revealed to us. We do record personal information that is voluntarily provided, such as your name, email and postal address when you register for an account for the purposes of purchasing artwork via Duke Street Art Ltd. When you submit a question through the Contact Us page we need your email address to respond.

 

The information that you volunteer may be used in a number of ways, including the following: To send out emails to users who have subscribed to our mailing list. Periodically we may also send out emails to inform registered users about upcoming exhibitions and events that we think might be of interest to them.
